Terms and Conditions
Welcome to the KND-Store Virtual Store (the "Virtual Store"). The use of the Virtual Store is governed by the terms and conditions described below, which regulate the access and use that you, as a user, can make of the Virtual Store.
By accessing or using the Virtual Store, you declare that you know and accept the provisions set forth in these terms and conditions, as well as our privacy policy, expressing your full agreement with both documents. We ask you to carefully read the Terms and Conditions that govern the use of the web platform, along with the scope of the products provided through it.
It is a requirement to purchase at the KND-Store Virtual Store to accept the Terms and Conditions of sale described below. Any person who makes a transaction in the Virtual Store or through the telephone number (Personal Shopper) that KND-Store designates for such purpose, declares and acknowledges, by making the purchase, that they know and accept each and every one of the Terms and Conditions described.
The User accepts and acknowledges that KND-Store may update these Terms and Conditions of use, if deemed appropriate, without prior notice. Therefore, it is the responsibility of users to review the terms and conditions regularly. Continued use of the Web Platform will imply the acceptance and agreement of the user with any modification that may have taken effect.
The terms and conditions contained in this instrument will be part of all acts, transactions, and contracts that are executed or celebrated through the offer and marketing systems included in this Web Platform, between the clients of this site and the company.
Likewise, access to the services of this Virtual Store could occasionally be suspended or restricted for the purpose of carrying out repair or maintenance work, or the introduction of new products or services. We will try to limit the frequency and duration of such suspensions or restrictions.
1. General
For the purposes of these Terms and Conditions, the following terms shall have the meaning established in this clause:
- a) User: Any natural person who uses or accesses the KND-Store Web Platform to use its services, whether or not they have gone through the registration process on the Web Platform.
- b) Data holder: The natural person who registers their data in the KND-Store Virtual Store.
- c) Virtual Store: Website managed by Verne Lima S.A.C
2. Customer Registration
To be able to use the services offered by the Virtual Store, it is necessary to have prior user registration. KND-Store will require personal information from the User, in order to register them in the Virtual Store and to guarantee the security of the purchase transactions that are made. The data that KND-Store will require from the User are:
- Full name;
- Type and identity document number;
- Email address;
- Cell phone number; and,
- Any other relevant data for the operation of the Virtual Store.
Once registered in the Virtual Store, the User will be able to use the services. The User is obliged to maintain the confidentiality of their password. KND-Store is not responsible for the security of the User's password.
The data provided by the customer and their interaction with the Virtual Store will also be used to show the customer offers, promotions and/or products in a personalized way according to their preferences, as long as the customer has an active session in their browser.
The customer registered in the Virtual Store can arrange access, rectification, cancellation or opposition of their data when they deem it convenient.
3. Secret Password
The user will have, once registered, a username and password or definitive password that will allow personalized, confidential and secure access. The user will have the possibility to change the access password, for which they must follow the procedure established on the respective site. The user assumes full responsibility for maintaining the confidentiality of their secret password registered on this website, which allows them to make purchases, request services and obtain information. This password is for personal use and its delivery to third parties or its misuse does not involve KND-Store's responsibility.
4. Payment Methods
To purchase the products offered in the Virtual Store, Users must make payment of the sale price through one of the valid payment methods that have been allowed by the Virtual Store, in accordance with the provisions of this clause.
The user accepts that all payments made from the Virtual Store will be processed through the company Compañía Incubadora de Soluciones Móviles S.A, for which they may use the following means:
Payment by Credit or Debit Card: Only Visa, Master Card, Diners and American Express credit or debit cards are accepted, as long as they have been issued by local banking entities and are enabled to make purchases online. The transaction that the User makes will be subject to verification by the company Compañía Incubadora de Soluciones Móviles S.A. A transaction will not be considered complete while KND-Store does not receive the respective authorization from the Culqui payment gateway certifying the validity of the payment. If KND-Store does not receive such confirmation, the purchase will be canceled.
Hoseg will not be responsible for the problems that may occur on the occasion of the services provided by the payment processing companies or the companies that provide banking or financial intermediation services that the user has chosen to carry out the purchase operations through the Virtual Store.
5. Purchase Cancellation
The customer may request the cancellation of the purchase through KND-Store's customer service channels up to three (3) days before the estimated dispatch date. Once the cancellation request is received and reviewed, the payment method issuing entity will be notified of the chargeback request, the processing time of the operation varies according to the payment method used at the time of purchase.
Likewise, purchases made at KND-Store are subject to availability verification, which may be communicated even after the payment receipt has been issued. In case the product is not available, we will contact you by email or via whatsapp, in order to inform you of the purchase cancellation, unless within the period indicated in said communication we receive contrary instruction through the channel established for that. Said verification may be communicated up to one (1) day before the scheduled delivery date.
In case the purchase has been made with a credit and/or debit card, the time of the refund/release of funds is the responsibility of the financial entity that issued the card. KND-Store is not responsible for any delay or incident that the Financial Entity presents for the execution of the refund operation.
6. Dispatch and Delivery Conditions
The products purchased through the site will be subject to the dispatch and delivery conditions chosen by the user and available in the Virtual Store. When a purchase order contains products from different warehouses, they will be dispatched independently, according to the alternatives available on the site and chosen by the user. The shipping location information is the sole responsibility of the user. It is important that the customer takes into account that the chosen delivery times are counted from when KND-Store has validated the purchase request and the payment method used. The selected date may be exceptionally modified by the system, depending on the order validation date.
Once the transaction is completed and the purchase confirmation is sent to the email address provided by the User, KND-Store undertakes to dispatch the products within five (5) business days for Metropolitan Lima and (15) business days for Provinces, and deliver them to the address designated by the user. Business days are considered those from Monday to Friday, with the sole exception of holidays or festive days.
Some exceptional situations could affect the development of logistics services and cause dispatch times to be longer than the times stated in the previous paragraph. If so, this will be informed to the User during the purchase process.
The delivery of the products will be made through the company Scharff to the address indicated by the User. The User accepts that the delivery service will be limited to certain cities in Peruvian territory.
Take into account the following considerations:
- It is the User's responsibility that the data related to the dispatch address, provided in the Virtual Store, are correct, as well as that at the time of delivery of the purchase there is an adult present at said address to receive it, who must identify themselves with an identity document.
- In the event that the data related to the dispatch provided by the User do not allow the delivery to be completed, or in case a person capable of receiving the merchandise was not found, the product will not be delivered and it will be automatically rescheduled for the next available date and the customer will be notified by any of these means: email, Whatsapp, telephone informing them of the reasons for the return of their order and they will be asked to validate the data provided in the Virtual Store, it being the customer's responsibility to be attentive to the new delivery. KND-Store only commits to make a single additional rescheduling to the first shipment.
- In case the second shipment is not completed, KND-Store will automatically cancel the Purchase Order. The refund will be made according to the payment method used in the original purchase transaction. The corresponding credit note will be sent by email to the customer. The amount paid for freight will not be refunded.
- In case there is a change in the delivery address provided during the purchase, it will be the User's responsibility to inform Hoseg before the product has left for dispatch.
- All dispatches will be accompanied by a delivery guide. At the time of delivery of the product, it is the responsibility of the User (or the person receiving the product on their behalf) to check that it comes in optimal conditions, without adulterations and without any defect. The receipt and delivery of the product, without any observation or objection, will be understood as acceptance and conformity of the User with the state and condition in which the product is found. In case of disagreement, they must reject the delivery and indicate their reasons, name, signature and ID number in the delivery guide.
- After acceptance of the dispatch, KND-Store is not responsible for physical damage to the product. Therefore, only the application of the warranty will be attended to as established in point 11 of these Terms and Conditions.
The dispatch and/or delivery of the products may be carried out through the modalities indicated in this section, according to availability shown in the product sheet.
7. Personal Shopper Sales (Whatsapp)
All purchases made via Whatsapp will go through a data validation process during the conversation, where KND-Store will request certain data according to the payment method used to carry out the transaction. If it does not pass validation, the customer will be told that the purchase must be made through the Virtual Store.
The payment methods with which purchases can be made through this channel is via bank transfer to the company's accounts. For this, the personal shopper will provide this information to the customer.
8. International Shipping
Estimated delivery times are:
- America: 2-3 business days
- Europe: 3-5 business days
- Asia and Oceania: 5-7 business days
- Rest of the world: 7-10 business days
The company is not responsible for delays caused by: government restrictions, transportation route stoppages, unfavorable weather conditions, and other incidents that may delay the order.
For international shipments, the tariffs or taxes generated by the entry of the product will be borne by the customer.
All purchases made at KND-Store are shipped from Peru.
Important information about taxes or tariffs
Please note that international shipments may have additional charges (such as taxes and tariffs) once the shipment arrives in your country. Customs in each country determines the amounts.
The customer is responsible for paying any additional charges requested by the corresponding authorities.
Contacting Customs can help you know the amount of tax-free imports determined in your country and/or calculate how much you will have to pay in taxes for the item you are purchasing.
In case the customer refuses to receive their order due to additional charges determined by Customs, KND-Store reserves the right to charge them the costs of both shipping and return of the product, as well as any additional amount generated by Customs.
9. Payment Receipts
The customer must correctly decide the type of electronic document they will request as a payment receipt for their purchase, since according to the Payment Receipt Regulations approved by Superintendence Resolution No. 007-99/SUNAT (RCP) and the Consolidated Text of the General Sales Tax and Selective Consumption Tax Law, approved by Supreme Decree No. 055-99-EF and amending regulations, no change will proceed:
"There is no current procedure that allows the exchange of sales receipts for invoices, moreover credit notes are not intended to modify the purchaser or customer appearing in the original payment receipt".
By accepting these terms and conditions, the customer authorizes KND-Store to send the electronic receipt to the email address provided in the purchase process, which can be viewed through the Virtual Store and will be sent physically at the time of order delivery.
10. Validity, Validity and Stock of Offers Contained on This Website
The prices and services displayed at KND-Store are exclusive for purchases made at the Virtual Store and are not applicable to transactions made in other stores and/or Hoseg channels. Likewise, the prices and services displayed in other stores and/or channels do not necessarily apply to transactions made at KND-Store
The prices of the products listed in the Virtual Store are in Peruvian national currency (S/), as are the payment receipts that are issued.
The prices of products and services published on this website will be valid only as long as they appear on it. Hoseg may modify any information contained on this site, including those related to merchandise, services, prices, stock and other conditions, at any time and without prior notice. The stock offered is 1 product per offer.
The conditions for product exchange are those expressed in point number 11, for its execution it is necessary to comply with the requirements requested in that document.
In case the customer requests the exchange of a product purchased with a discount through the Virtual Store, for another product available in the store (in accordance with what is established in the return and exchange policy clause), the discount from the first purchase may not be applied to the new product that is the object of exchange, and the sale price of the product in the store must be considered.
The subscription code where you get the 10% discount is only applicable to selected products from specific collections. Does not apply to other cumulative promotions or discounts.
KND-Store is not responsible for the information provided by other websites and the consequences derived from it, especially when access to the Virtual Store site has been made through a link or banner on sites that do not have contracts or alliances with KND-Store
11. Warranty
If the product you purchased is damaged or incomplete, you can exchange or return it by coordinating at the following email: nimbo@me.com and request pickup of the product, indicating the receipt, invoice or purchase ticket number. The product pickup time will depend on the city according to the deadlines and coverage of our Courier. The User must present their receipt, purchase invoice or exchange ticket. Once the KND-Store Distribution Center receives the product, it is verified whether or not the warranty proceeds and the User will be contacted to confirm the decision. The warranty is granted for the first 48 hours after the order is delivered. Exchanges are made as long as the garment has not been used. In case the product has a factory defect, you must notify within 72 hours to make the garment exchange. If this period passes, it is the customer's responsibility and the exchange cannot be made.
At the time of making the request either in the store or for cases where there is no physical store of the brand through our call center or email mentioned above, the product will be sent to the technical analysis department, where the deficiency will be evaluated to rule out that it is due to misuse of it. The answer will be available through your email or by phone, within ten (10) business days of receiving the product in the store or in case of shipment by Courier by the technical department. If you require us to contact you by another means, you must request it at the same store, leaving the corresponding data or writing to nimbo@me.com
Conditions to make the warranty effective:
- The damage that the product presents cannot be attributable to the customer or third parties.
- The warranty will only cover defects with factory origin within a period of 72 hours.
- You must have the ticket or electronic receipt, which certifies the acquisition of the product.
- The warranty will apply if the product has recycling defects: seams, zipper failures. For the application of the warranty, the brand through its authorized technical service will determine, after evaluation of the damage or failure.
- This warranty does not cover products purchased on clearance.
Conditions that invalidate the warranty
- Upon the occurrence of an act of God or force majeure of any kind after delivery, including: earthquakes, fires, floods, spills of liquids or gases that affect the integrity and quality of the product.
- When the product or any of its components present failures caused by mistreatment, lack of knowledge, failure to follow instructions or misuse for several months.
- In case the product is used for a purpose other than that for which it was designed.
If the failure is due to a product deficiency, you can exchange it for any product in the store or request a refund of the amount paid as indicated on the receipt, purchase invoice or exchange ticket. It should be noted that this warranty does not cover damage caused by accident, misuse, mistreatment (including accidents at airports or any means of transport), regular use, cracks or theft. Accidental or fortuitous loss of contents.
To make the money refund, you will be asked to fill out a form with your personal data and your bank account data to issue a Credit Note or make a bank transfer for the corresponding amount, within no more than five (5) business days from the acceptance of the use of the warranty. KND-Store will not make cash refunds.
